Terms of Service

1. Scope

These Terms of Service apply to the use of the online service Shakeon, operated by [Name], [Address] (hereinafter "Provider"). By registering and using the service, the user agrees to these Terms of Service.

2. Service description

Shakeon is a web-based documentation tool for freelancers and self-employed individuals. The service allows users to:

• Capture and store project scopes in a structured way
• Send confirmation links to clients
• Document time-stamped confirmations
• Manage change requests

Shakeon is explicitly a documentation and communication tool. The service does not create legally binding contracts, notarized documents, or qualified electronic signatures pursuant to the eIDAS Regulation.

3. Registration and user account

Use of Shakeon requires registration. The user is obligated to provide accurate information during registration and to keep it up to date. User accounts are non-transferable. The Provider reserves the right to suspend or delete accounts in case of violations of these Terms of Service.

4. Free and paid plans

Shakeon is available in a free version (Free) and a paid version (Pro). The Free plan is limited to one active project. The Pro plan is billed monthly and can be cancelled at any time via Stripe. Prices are available at shakeon.io/#pricing.

Upon cancellation of the Pro subscription, the user retains access to Pro features until the end of the paid period. Afterwards, the account is automatically downgraded to Free.

5. User obligations

The user agrees to:

• Not use the service for any unlawful purposes
• Not store sensitive or confidential data (e.g. passwords, payment information, personal ID details) in projects — Shakeon links are accessible to anyone who has the link
• Not harass or harm third parties
• Not overload or manipulate the service

6. Limitation of liability

The Provider is not liable for any damages arising from the use or non-use of the service, unless such damages are caused by the Provider's gross negligence or wilful misconduct.

In particular, the Provider assumes no liability for the recognition of project scopes documented via Shakeon as legally binding contracts in court. Shakeon serves documentation and communication purposes, not legal advice.

7. Availability

The Provider strives for high availability of the service but does not guarantee uninterrupted operation. Maintenance work will be announced in advance where possible.

8. Changes to the service and Terms of Service

The Provider reserves the right to further develop the service, add or remove features, and update these Terms of Service. Material changes will be communicated to users by email. Continued use of the service after the updated Terms of Service take effect constitutes acceptance.

9. Termination

Users may delete their account at any time. The Provider may suspend or delete accounts in case of violations of these Terms of Service without prior notice.

10. Governing law

These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is [City], provided the user does not have a general place of jurisdiction in Germany.
